Welcome to Pillbuddy (the “App”), Please read these Terms and Conditions (“Terms”) carefully. They form a binding legal agreement between you and Hexia Health (“We,” “Us,” or “Our”).

1. Acceptance of Terms

By downloading, accessing, or using Pillbuddy, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App and must immediately delete it from your device.

2. Purpose and Status of the App

Pillbuddy is a health support and organization tool only.

IT IS NOT A MEDICAL DEVICE, AND IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The App is intended solely to support your personal health management by organizing information and providing reminders. It is not a substitute for the expertise of your physician, pharmacist, or other qualified healthcare provider.

  1. Always consult your physician or other qualified health professional regarding medical conditions, concerns, or before starting, stopping, or changing any medication or treatment plan.
  2. Never disregard professional medical advice or delay seeking it because of information or suggestions provided by the App.
  3. We make no representations or warranties that the App or any of its features will diagnose, treat, or prevent any disease or medical condition.

Key Features

The App provides the following features. You acknowledge and agree that these features are for informational purpose only:

a. AI- Powered Medication Shortage Alert: Automated notifications for scheduled doses and low supply. We do not guarantee the reliability, accuracy, or timeliness of these reminders. You are solely responsible for taking your medication as prescribed.

b. Medication Reminder:PillBuddy reminds you to take your medication on time, anywhere. It’s the easiest way to stay on track with your treatment.

c. Family & Caregiver Alerts: With your explicit, revocable consent, designated individuals may receive notifications (e.g., for a missed dose).

d. Gamification: Features like points, streaks, or rewards are designed to encourage adherence but are not an endorsement of any particular treatment.

e. Cookies & Tracking Technologies: Used to enhance user experience, personalize features, and improve performance, as detailed in our Privacy Policy.

f. Chatbot: PillBuddy’s friendly chatbot allows you chat with customer support at any time.

g. Personalised Health Tips: PillBuddy offer a personalised health insight based on the medication you are using.

3. Eligibility and Consent

To use the App, you must be at least 18 years old.

  1. If you are under 18, you confirm that you have received consent from your parent or legal guardian to use the App, and they have agreed to these Terms on your behalf.
  2. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Responsibilities

By using Pillbuddy, you agree to:

  1. Ensure Accuracy: You are solely responsible for the accuracy of all data you enter, including medications, dosages, schedules, and symptoms.
  2. Maintain Security: Keep your account details, passwords, and device access secure. You are responsible for all activities that occur under your account.
  3. Obtain Consent: Obtain express, verifiable consent from any family member or caregiver before designating them to receive your health-related data or notifications through the App.
  4. Compliance: Use the App only for its intended purpose and in compliance with all applicable local, state, national, and international laws.
  5. Professional Reliance: Not rely solely on the App for critical health or medical decisions, including when to take or refill medication.
  6. Subscription Plan

The app offers both free and premium features. Paid services will be clearly identified, and all charges will be communicated before purchase.

All payments are handled through secure third-party payment processors.

6.Cancellation Policy

  1. Monthly Subscriptions: You may cancel your monthly subscription at any time. The cancellation will take effect at the end of your current billing cycle, and you will not be charged for the subsequent month.
  2. Annual Subscriptions: Annual subscriptions can be canceled at any time, but refunds will be prorated based on the number of months remaining in the subscription period. A small cancellation fee may apply.

7.Refunds

Refunds are provided under the following conditions:

  1. Monthly Subscriptions: No refunds are issued for partial months.
  2. Annual Subscriptions: Prorated refunds will be issued based on the unused portion of your subscription. The refund amount will be calculated from the date of cancellation to the end of the subscription period, minus any applicable fees.

8.No Refund Situations

Refunds will not be issued in the following situations:

  1. If you fail to cancel your subscription before the next billing cycle begins.
  2. If your account is terminated due to violations of our Terms of Service or other policies.
  3. If the services were fully utilized before cancellation.

9.Reinstatement:

If you decide to reactivate your subscription after cancellation, you may do so by logging into your account and subscription. Please note that previously earned benefits or promotions may not be reinstated.

10.Changes to Cancellation Policy:

We reserve the right to modify or update this Cancellation Policy at any time. Changes will be effective immediately upon posting to our website or app. We will notify you of significant changes via email or through the app.

12. Disclaimer of Warranties and Limitation of Liability

We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LIMITATION OF LIABILITY:

  1. Hexia Health Limited and its affiliates, officers, directors, employees, agents, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of health, bodily injury, emotional distress, data, profit, or other intangible losses resulting from:
    • Missed reminders, medication errors, adverse health outcomes, or reliance on symptom/disease suggestions.
    • Any failure of the App to operate as intended.
    • The unauthorized access to or alteration of your transmissions or data.
    • Any other matter relating to the App.
  2. You are solely responsible for confirming refill needs, medication instructions, and any symptom or dose information with your healthcare provider or pharmacist.

13. Third-Party Services

The App may contain links to or integrate with services provided by third parties (e.g., pharmacies, other health services). We do not control, endorse, or assume any responsibility for the services, content, privacy policies, or practices of any third-party websites or services. You access and use these third-party services entirely at your own risk.

14. Intellectual Property

All content, design, software, code, algorithms, and trademarks of PillBuddy are the exclusive property of Hexia Health Limited is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only. You may not copy, distribute, modify, create derivative works of, publicly display, or reverse engineer any part of the App without our prior written consent.

15. Termination of Use

We reserve the right, in our sole discretion, to suspend or terminate your access to the App at any time, for any reason, including, but not limited to, any breach of these Terms or misuse of the App. Upon termination, your right to use the App will immediately cease.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration in the United Kingdom, except that you may assert claims in small claims court if your claims qualify

17.Updates to Terms

We may modify these Terms at any time by posting the revised Terms on the App or a related website. The "Last Updated" date at the top will indicate when the changes were effective. Your continued use of the App after the effective date of the revised Terms means that you accept and agree to the changes.

  6. Cookies & Tracking Technologies: Used to enhance user experience, personalize features, and improve performance, as detailed in our Privacy Policy.
  7. Chatbot: PillBuddy’s friendly chatbot is always ready to help. You can chat to get quick answers about your medication schedule or speak with a Pharmacist or Doctor. It also provides helpful tips, encouragement, and reminders to keep you motivated and in control of your health.
  8. Personalised Health Insight: PillBuddy offer a personalised health insight based on the medication you are using.
